These Terms of Service ("Terms") govern your use of Ritely ("we," "us," "our"), a Shopify application that generates product descriptions using artificial intelligence. By installing or using Ritely, you agree to these Terms.

1. Service Description

Ritely generates product descriptions, meta titles, meta descriptions, and bullet points for products in your Shopify store using Anthropic's Claude AI. The service includes single-product generation, bulk generation, brand voice configuration, image analysis, and quality scoring.

2. Account and Access

• Ritely is available exclusively through the Shopify App Store and operates within the Shopify admin panel.
• You must have an active Shopify store to use Ritely.
• By installing Ritely, you authorize us to access your product data (titles, descriptions, images, tags, variants, metafields, and collections) via the Shopify API as described in our Privacy Policy.
• You are responsible for maintaining the security of your Shopify account.

3. AI-Generated Content

Your responsibility to review. Ritely generates descriptions using AI. While we design our systems to produce accurate, high-quality content, AI-generated text may occasionally contain errors, inaccuracies, or content that doesn't meet your standards. You are responsible for reviewing all generated descriptions before publishing them to your store.

No guarantees of accuracy. We do not guarantee that generated descriptions are factually accurate, free of errors, or suitable for any particular purpose. Ritely includes safeguards against fabrication (anti-hallucination prompting, factual verification, quality scoring), but these safeguards are not infallible.

Your content, your responsibility. Once you publish a generated description to your Shopify store, it becomes your content. You are responsible for ensuring published descriptions comply with applicable laws, including consumer protection regulations (such as FTC requirements for truthful advertising), intellectual property laws, and any industry-specific regulations.

No AI training on your data. Neither Ritely nor our AI provider (Anthropic) uses your product data or generated descriptions to train AI models.

4. Acceptable Use

You agree not to:

• Use Ritely to generate content that is illegal, fraudulent, misleading, defamatory, or harmful.
• Attempt to reverse-engineer, decompile, or extract the AI models or prompts used by Ritely.
• Use automated means to access Ritely beyond its intended interface.
• Resell or redistribute Ritely's services without our written permission.
• Exceed the usage limits of your subscription plan through technical manipulation.

5. Subscription and Billing

• Ritely offers Free, Starter, Growth, and Scale subscription tiers.
• All billing is handled through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge your account.
• Credits reset monthly based on your billing cycle.
• Unused credits do not roll over between billing periods.
• You may upgrade, downgrade, or cancel your plan at any time through the Shopify admin.
• Refunds are handled in accordance with Shopify's billing policies.
• The Scale tier includes priority support.

6. Intellectual Property

Your content. You retain all rights to your product data and to descriptions you publish. Ritely does not claim ownership of your content.

Our service. Ritely's application, design, prompts, brand voice system, and associated technology are our intellectual property. These Terms do not grant you any rights to our intellectual property beyond the right to use the service as intended.

Generated descriptions. Descriptions generated by Ritely are produced by Anthropic's Claude API. Under Anthropic's Commercial Terms, you receive rights to use AI-generated outputs for your commercial purposes. We do not claim ownership of generated descriptions.

7. Service Availability

• We aim to maintain high availability but do not guarantee uninterrupted service.
• Ritely depends on third-party services (Shopify API, Anthropic API) that may experience outages beyond our control.
• We will make reasonable efforts to notify users of planned maintenance or known outages.
• Generation times for bulk operations may vary based on catalog size and API availability.

8. Limitation of Liability

To the maximum extent permitted by law:

• Ritely is provided "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total liability for any claims related to the service is limited to the amount you paid for Ritely in the 12 months preceding the claim.
• We are not liable for any losses resulting from AI-generated content that you published to your store, including but not limited to lost sales, reputational harm, or regulatory penalties.

9. Indemnification

You agree to indemnify and hold harmless Ritely, its operators, and affiliates from any claims, damages, or expenses arising from:

• Your use of the service
• Content you publish using Ritely
• Your violation of these Terms
• Your violation of any applicable laws or regulations

10. Data and Privacy

Our collection, use, and handling of your data is governed by our Privacy Policy. By using Ritely, you acknowledge and agree to the practices described in the Privacy Policy.

11. Termination

• You may stop using Ritely at any time by uninstalling the app from your Shopify store.
• We may suspend or terminate your access to Ritely if you violate these Terms, engage in abusive behavior, or if required by law.
• Upon termination, your data will be handled as described in our Privacy Policy (full deletion within 48 hours of Shopify's redaction webhook).

12. Changes to These Terms

We may update these Terms from time to time. We will notify active users of material changes via email or in-app notification. Your continued use of Ritely after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Delaware.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
